The Data Privacy and Compliance Officer (DPCO) is responsible for collaborating across the organization in designing, developing, implementing, monitoring, and communicating the data privacy and compliance program for the systemwide UC Education Abroad Program (UCEAP). This position is charged with ensuring UCEAP's operational, regulatory, legal, and policy alignment with and adherence to a wide range of applicable international and U.S. federal/state laws, rules, and regulations. This includes University policies and procedures, accepted business practices, ethical standards, and contractual obligations. Formally serves as UCEAP's designated Privacy Officer and Policy Coordinator. Regularly leads and/or collaborates on projects of critical importance to the organization that carry substantial consequences of success or failure. Functions as a resource and technical leader with a high degree of knowledge in all areas of compliance relevant to the organization. Conducts complex research and analysis and develops solutions for a wide range of policy and compliance issues without prior precedent and unique to international operations. Analysis of issues often requires an in-depth evaluation of variable factors. The DPCO is a designated point of contact for certain internal and external inquiries regarding UCEAP privacy and compliance. The DPCO works closely as a core liaison with the UC Office of the General Counsel (UC Legal) and relevant subject matter experts to coordinate organization-wide initiatives. Involves understanding and application of a range of international and U.S. federal/state laws and regulations to a wide variety of activities, including academic and non-academic-related activities that have implications for UCEAP operations and academic programs. Provides interpretation and guidance to UCEAP unit Directors and subject matter experts regarding complex issues ranging from foreign liability risks to global data privacy. Acts as liaison with internal clients, UC Legal, international counsel, and external organizations as applicable. Serves as the organization's formal Privacy Officer responsible for the development, oversight, maintenance, and adherence to UCEAP's global privacy compliance program encompassing U.S. federal and state privacy laws as well as the EU General Data Protection Regulation (GDPR) and other international privacy laws applicable to UCEAP activities. Responsible for coordination of the UCEAP study center contracts administration and review process. Provides reviews to ensure compliance of complex international agreements and contracts critical to the core mission of the UC Education Abroad Program. Reviews and approves, and/or develops and revises, certain UCEAP contract and agreement terms and conditions to ensure alignment with UC policy, and international and U.S. federal/state laws. Serves as a designated point of contact and resource for UCEAP leadership and staff, regularly responding to requests for information, analysis of program and operational compliance, and review of related contract provisions. 



Requirements

Bachelor's Degree in a related field and three or more years of compliance/legal experience; or equivalent combination of education, training, and experience (e.g., paralegal certification and 5 years of relevant experience).

  • Advanced knowledge of organizational compliance concepts and systems of internal control. 
  • Broad and thorough knowledge of university (or similarly complex organization) compliance policies, procedures, and programs. 
  • Ability to work independently and collaboratively with organizational units and workgroups 
  • Ability to extract, verify, compile, and develop recommendations related to compliance programs, issues, policies, and procedures. 
  • Thorough understanding of the interrelationship of procedures and desired results. 
  • Ability to research, organize, analyze, and produce written and oral reports on issues and recommendations that are complex in nature. 
  • Expert knowledge of policy analysis techniques and ability to effectively apply policy and legal concepts to a wide variety of issues and recommendations. 
  • Demonstrated knowledge of organizational policies and procedures and ability to balance them with legal and compliance requirements in the U.S. and abroad. 
  • Knowledge and understanding of information privacy laws and best practices, including federal, state, and international laws (e.g., the EU's General Data Protection Regulation--GDPR), policies and standards, as well as extensive knowledge about privacy regulations relevant to higher education. 
  • Thorough knowledge of legal principles and terminology; solid legal research skills. 
  • Thorough knowledge of standard contract terms; understanding of contract law and related legal areas such as insurance and indemnity. 
  • Strong written, verbal, and interpersonal communications skills; ability to collaborate and deal effectively with broad and diverse constituencies ensuring strong customer service orientation and skills. 
  • Advanced organizational and compliance project management skills. Demonstrated flexibility and ability to handle multiple, competing responsibilities. 
  • Ability to present complex issues in a clear and concise manner, both in writing and verbally for presentation or review by legal counsel and organization leadership. 
  • Ability to compile this data and draft technical reports that will serve as official documentation and records of programs, policies, and procedures. 
  • Demonstrated knowledge of record-keeping requirements as well as records management systems and methods. 
  • Advanced proficiency with MS Office; familiarity with data systems, and ability to learn and utilize new technology, digital tools, and other systems. 
  • Ability to use appropriate discretion and maintain the highest level of confidentiality.

Preferred

  • Advanced knowledge of higher education regulations, policies and procedures. 
  • Professional certification(s) applicable to job responsibilities  
  • Juris Doctorate (JD) 
  • IAPP Certification: Certified Information Privacy Professional Europe (CIPP/E)  
  • Certified Information Privacy Manager (CIPM)
